The Time Wayne Smith Hired TWO Democrat State Reps to Sue a Widow and Kids

In Eastern Harris County, Rep. Wayne Smith is in the political fight of his life, after challenger Briscoe Cain shocked the state by besting the 14-year incumbent by nearly five percentage points, sending the race into a runoff. As most observers know, runoff elections are traditionally tumultuous  for incumbent politicians, and after some recent spurious attacks by the career politician, it seems Rep. Wayne Smith has some explaining to do.

Why would a Republican State Representative falsely accuse his opponent of being a personal injury lawyer when he in fact hired two liberal Democrats to sue a widow and her children for the ’emotional distress’ he suffered in an auto accident?

In November of 1994, Wayne Smith brought a frivolous personal injury lawsuit against the widow and children of a man who lost his life in a car wreck on November 27, 1992.

$665,350.00 for Mental Anguish & Mental Anxiety?

As if suing a window wasn’t low enough, Smith sought a monetary award totaling $665,350.00 alleging he suffered “Mental Anxiety” and “Mental Anguish.”

Anyone who has seen his liberal voting record won’t be surprised that Smith hired Two Democrat State Representatives to be his legal henchmen.

That’s correct! Wayne Smith enlisted the help of his friends, Democrat State Rep. Craig Eiland and Democrat State Rep. Fred BosseTwo personal injury trial lawyers who were both, at the time of the lawsuit, Democrat State Representatives.

As you know, birds of a feather flock together.

After more than three years of litigation, Smith and his liberal democrat state rep. lawyers voluntarily dropped the lawsuit–Smith was awarded $0.00 and the widow and heirs were stuck with the bill they amassed for having to defend the frivolous suit.

To add insult to injury Smith’s hired guns asked some pretty insulting questions of the widow and family. Questions only a plaintiff seeking to bring pain to his opponent would ask.

By interrogatory, Smith’s liberal lawyers asked the heirs the following: “describe in your own words, in as much detail as you are able, how the collision occurred” and “state your legal relationship to [the deceased] prior to the date [he died].”

So let’s sum up this up.  Wayne Smith has falsely attacked Briscoe Cain for being a personal injury trial lawyer, when he himself has actually enlisted two sitting Democrat State Reps to sue a widow and her children in a personal injury case.  The hypocrisy is astounding.  However, given Smith’s anemic chances in the May 24th race, we shouldn’t be surprised to continue to see desperate attacks from the 14-year career politician.
